Terms & Conditions
By planning travel with Liv to Travel, you agree to be bound by these terms and acknowledge that Liv to Travel acts solely as a booking agent for disclosed principal suppliers and is not the source or provider of the travel services.
Use of Services, Access & Information
You warrant that you are at least 18 years of age and possess the legal authority to enter into these Terms and Conditions and to make travel bookings with Liv to Travel. You agree to be financially responsible for all travel bookings made on behalf of yourself and any member of your traveling party, and warrant that all information supplied is true and accurate.
You agree that you will only make legitimate reservations or purchases with Liv to Travel and its Suppliers. Without limitation, any speculative, false, or fraudulent reservation is prohibited.
All bookings are accepted by Liv to Travel as agent for the travel Suppliers on your itinerary. Separate Supplier terms and conditions will apply to your reservation, and you understand and agree to abide by the terms and conditions imposed by any Supplier selected as a service provider on an itinerary you have approved.
Payments & Cancellations
You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings. By submitting a credit card authorization form or uploading a credit card through Liv to Travel's booking platform, you agree to allow Liv to Travel to use your payment method to purchase travel products from Suppliers on your behalf.
Client agrees not to initiate a chargeback or payment dispute for properly disclosed and authorized travel charges. In the event of a chargeback, Client agrees to reimburse Liv to Travel for all reasonable costs incurred in responding, including administrative expenses, bank fees, attorney fees, and collection costs, where permitted by law.
All payments for travel are due according to each Supplier's terms. Failure to make final payment may result in cancellation of reservations or forfeiture of monies paid. In some cases, there is no refund once a booking is made and under deposit.
All cancellation requests must be sent to Liv to Travel in writing by email at olivia@liv-to-travel.com, except in the case of bookings made through TravelWits.
As a result of cancellation, the Supplier's cancellation penalties will apply. Cancellation fees will be charged to the authorized payment method or deducted from any Supplier refund.
Travel Documents
It is the responsibility of each Client to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations. The name, date of birth, and gender on your identification must exactly match the same data listed on your airline ticket(s) and booking records.
When you receive any and all travel documents, it is your responsibility to review and verify all information for accuracy. Contact Liv to Travel immediately if changes or corrections are required.
Liv to Travel strongly recommends taking into account that certain countries will not admit a passenger if their passport expires within six (6) months of the anticipated date of return. Non-United States citizens may require additional documentation.
Children and infants also require travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted unless authenticated consent forms are provided to the authorities.
Individual Entry & Exit Requirements
Each country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or prior criminal offense, contact that country directly for entry and exit requirements. Further information is available at travel.state.gov.
Liv to Travel does not inquire about an individual's criminal record in the interest of respecting our Clients' privacy.
Health & Immunizations
You must have the proper immunizations, health screenings, and required documentation before travel. Liv to Travel shall not assume responsibility for the accuracy of health or vaccination documentation. In some cases, required inoculations must be recorded by your health practitioner on a valid vaccination certificate.
Client acknowledges responsibility for determining that they and all members of their traveling party are medically and physically fit for travel, and for the activities included in the itinerary. Client further acknowledges responsibility for disclosing any disabilities, mobility limitations, dietary restrictions, or medical conditions that may affect travel arrangements.
For health-related travel information, please consult the U.S. State Department and the Centers for Disease Control.
Air Travel, Schedule Reconfirmation & Check-In
Liv to Travel shall not assume any responsibility for air schedule changes. In rare instances, certain departure taxes must be paid in cash only upon departure from a country. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares.
Airline e-tickets expire one year from issue date unless carrier fare rules provide otherwise. It is strongly recommended that you check in a minimum of 2 hours prior to domestic departures and 3 hours prior to international departures. Please reconfirm flight times at least 24 hours prior to domestic departures and 72 hours prior to international flights.
Right to Correct Errors
We reserve the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. All offers, incentives, and Supplier promotions are subject to availability and may change without notice. Prospective Clients are advised to reserve early to avoid disappointment, increases in fares, and additional late booking fees.
Unused Arrangements & Alterations
When tour, cruise, or package prices are based on Suppliers' contract rates, you will not be entitled to any refund for any unused portion of travel.
Some group tours are based on minimum numbers of passengers. If the number of passengers falls below the minimum required, a surcharge may be imposed, or the tour may be canceled. Any cancellations for failing to meet the minimum traveler requirement will be governed by the tour operator's cancellation policy.
If you decide to change any portion of your confirmed arrangements, we will attempt to assist you. All requests for changes must be made in writing to Liv to Travel. The Supplier may determine that alterations to an itinerary are necessary — including in the event of severe weather — and any such alterations are at the sole discretion of the Supplier.
Limitations of Responsibility
Liv to Travel acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of any travel service. Each Supplier is an independent entity with its own management and is not subject to the control of Liv to Travel.
Because Liv to Travel acts as agent for disclosed principal Suppliers and does not control the operations of such independent operators, you agree that Liv to Travel is not liable for any personal injury or property damage which may arise out of these services. Any recovery from Liv to Travel will be limited to the amount of commission and fees actually received by Liv to Travel.
Liv to Travel hereby disclaims any liability, whether based on contract, tort, strict liability, or otherwise, including without limitation any direct, punitive, special, consequential, incidental, or indirect damages in connection with goods or services provided by any principal Supplier.
Risks & Safety
Travel to certain destinations may involve greater risk than others. Liv to Travel urges Clients to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking international travel.
We recommend registering with the Smart Traveler Enrollment Program (STEP), a free service provided by the U.S. Government to U.S. citizens traveling to or living in a foreign country.
By offering for sale travel to particular destinations, Liv to Travel does not represent or warrant that travel to such points is advisable or without risk. Client's participation constitutes acceptance of such events at Client's own risk.
Client acknowledges responsibility for reviewing current travel advisories, entry requirements, health notices, and safety conditions applicable to their destinations prior to departure.
Force Majeure
Liv to Travel will not be in breach of these Terms and Conditions, or otherwise be liable, for any failure or delay in performing an obligation due to causes beyond its reasonable control, including: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, breakdown or malfunction of equipment, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, or explosion.
The purchase of travel insurance is highly recommended on all trips.
In the event that a Force Majeure event occurs, Suppliers may — in their sole and absolute discretion — vary, postpone, or cancel any itinerary or arrangement in relation to the trip. Payment of any refund as a result of non-performance shall remain in the sole and absolute discretion of the Supplier, pursuant to their policies.
Currency Fluctuations
Currency exchange rates fluctuate. Prices are subject to change based upon currency exchange rate fluctuations. Liv to Travel is not responsible for surcharges or foreign transaction fees imposed by Client's credit card or bank.
Travel Insurance
Liv to Travel offers access to travel insurance to protect passengers and their investment in travel. Unless specifically noted, travel insurance is not included in the cost of your itinerary. Proper insurance may protect you from financial loss in almost all circumstances.
Without appropriate travel insurance, if you cancel or interrupt your travel for any reason, portions of the trip may not be refunded and cancellation penalties will apply, resulting in the potential loss of monies up to the full cost of your travel booking.
Liv to Travel strongly recommends the purchase of comprehensive travel insurance. If you decline travel insurance, you may be required to sign a Travel Insurance Waiver. Liv to Travel is not a licensed insurance broker and cannot guarantee that any insurance provider will approve coverage for a claim made under an insurer's policy.
Client understands that travel disruptions caused by weather, illness, pandemics, government actions, supplier insolvency, or other unforeseen events may result in significant non-refundable losses.
Client Conduct
Each participant in any trip booked by Liv to Travel is expected to act responsibly and adhere to all behavior guidelines established by Liv to Travel and its Suppliers. Liv to Travel and all local Suppliers reserve the right to remove you from any facility, hotel, tour location, or means of transportation if your health or conduct endangers yourself or others, or disrupts the general well-being of other clients. In any such case, there will be no refund.
When you book with Liv to Travel, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss must be paid directly to the accommodation owner, manager, or other Supplier. Baggage and personal effects are always the sole responsibility of the participant.
Changes to These Terms
We reserve the right, in our sole discretion, to change these Terms and Conditions at any time. Updated versions will be provided to Clients, will be posted on our website, and are effective immediately upon posting.
Electronic Communications
Client consents to the use of electronic signatures, electronic records, and electronic communications — including email and online forms — in connection with all bookings, authorizations, acknowledgments, and agreements with Liv to Travel. Client agrees that electronic acceptance of these Terms and Conditions shall have the same force and effect as a handwritten signature.
General
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Client agrees that any dispute arising out of or relating to these Terms and Conditions shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.
Client grants Liv to Travel permission to use photographs, videos, testimonials, or other media voluntarily provided or publicly shared by Client relating to the trip for promotional and marketing purposes, without compensation, unless Client provides written notice opting out.
In any action arising out of or relating to these Terms and Conditions, the prevailing party shall be entitled to recover reasonable attorney's fees, costs, and expenses, to the extent permitted by applicable law.
If any part of these Terms and Conditions is determined to be invalid or unenforceable, that provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the agreement shall continue in effect.
These Terms and Conditions constitute the entire agreement between the Client and Liv to Travel with respect to travel bookings, and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
